GST Late Fees and Penalty: Complete Breakdown

Late fee for delayed return filing

Filing GSTR-1 or GSTR-3B after the due date attracts a late fee of ₹50 per day of delay (₹25 CGST + ₹25 SGST) for a return with tax liability, or ₹20 per day (₹10 + ₹10) for a Nil return with no liability — capped at a maximum of ₹10,000 per return under current provisions. This late fee accrues automatically and must be paid before the return can be successfully filed.

Interest on delayed tax payment

Separately from the late fee, interest at 18% per annum applies on the tax amount that was actually due but paid late, calculated from the day after the due date until the date of actual payment. Unlike the capped late fee, this interest has no upper limit and compounds the longer the delay continues, making it the more significant cost for businesses with substantial tax liability. Worked example₹1,00,000 GST liability paid 15 days late: late fee = 15 × ₹50 = ₹750, plus interest = ₹1,00,000 × 18% × (15÷365) ≈ ₹740 — a combined cost of roughly ₹1,490 for a two-week delay.

Penalty for non-filing beyond a certain period

Continued non-filing beyond the late-fee-accrual period can escalate to formal notices, provisional assessment by the tax officer, and in serious or repeated cases, penalty proceedings under Section 122 of the CGST Act, which can range up to ₹10,000 or the amount of tax evaded, whichever is higher, for specific offences like issuing invoices without actual supply or wilful non-payment.

Penalty for non-registration

A business required to register for GST that fails to do so, and is later found to have made taxable supplies without registration, faces a penalty typically equal to the tax amount evaded or ₹10,000, whichever is higher — in addition to being liable for the unpaid tax itself plus interest. This makes timely registration significantly cheaper than the cost of being caught unregistered later.

How to avoid GST penalties

  1. Set calendar reminders for the 11th (GSTR-1) and 20th (GSTR-3B) of every month — or track them live on the GSTFlix homepage.
  2. File Nil returns on time even with zero activity — the ₹20/day fee still applies for missed Nil filings.
  3. Reconcile ITC and tax liability early in the month rather than scrambling near the deadline.
  4. If a delay is unavoidable, file and pay as soon as possible — both the late fee and interest stop accruing from the date of actual filing/payment.
